1 – In general
1-1 After placing an order, the client of Once Upon a Bike agrees with the Terms and conditions.
1-2 Once Upon a Bike has the right to change the Terms and conditions.
1-3 Photos, colours and information in the Once Upon a Bike webshop are indications and can’t cause reimbursement or annulment of the purchase-agreement.
2 – Prohibitions
2-1 You must not misuse the Once Upon a Bike website. You will not commit/encourage a criminal offence, distribute a virus, trojan, worm or post any other material that is malicious or technologically harmful. Also you will not hack into any aspect of the service, cause annoyance to other users, or post spam. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Once Upon a Bike will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
3 – Product information
3-1 The product information is an indication and can’t cause reimbursement or annulment of the purchase-agreement.
4 – Order, agreement, payment and delivery
4-1 A purchase-agreement between Once Upon a Bike and the client is realized after the client has placed an order and Once Upon a Bike has shipped the order.
4-2 The client will receive an order confirmation by e-mail after Once Upon a Bike received the order.
4-3 Once Upon a Bike has the right to cancel an order, without giving a reason.
4-4 A delivery takes places when the item is in stock.
4-5 Orders can be paid by bank transfer, PayPal, iDEAL and MisterCash. In case of bank transfer, payment should be done within 14 days after the order placement. If payment is not received within 14 days, Once Upon a Bike has the right to cancel the order, without announcement.
5 – Terms of sale
5-1 All prices include 21% VAT.
5-2 All prices on Once Upon a Bike are probationary of misprints and/or typing mistakes.
6 – Privacy Policy
6-1 After a purchase-agreement client data will go to the Once Upon a Bike Client File. Data stay in the Ibizu Client File and won’t be given to third parties.
7 – Complaints
7-1 The client needs to check its ordered items when received. If it is the wrong item, incomplete of damaged, the client can send Once Upon a Bike an e-mail (info@onceuponabike.com)
7-2 If Once Upon a Bike agrees with the complaint, Once Upon a Bike will replace the item free of charge.
8 – Circumstances beyond one’s control
8-1 Once Upon a Bike is not liable when a purchase-agreement cannot be carried through, when circumstances beyond one’s control take place.
8-2 Circumstances beyond one’s control are: inexplicable causes/situations, delays by suppliers, Internet malfunctions, troubles in transport, strikes, government decisions, negligence of suppliers/manufacturers and illness of employees.
8-3 In case of circumstances beyond one’s control Once Upon a Bike has the right to postpone or to adjourn the purchase-agreement. In cases like these Once Upon a Bike is not liable and there will be no reimbursement.
